General Terms and Conditions

1. Scope of application
The following General Terms and Conditions apply to orders placed via our online shop by consumers and businesses.

A consumer is any natural person who concludes a legal transaction for purposes which predominantly are neither commercial in nature, nor attributable to self-employed professional activity. A business is a natural or legal person, or a legal entity, which when concluding a legal transaction is acting in its capacity as a commercial or professional enterprise.

These Terms and Conditions shall also apply to future business relationships vis-a-vis companies, without the need to make repeated reference to them. Should a business operate with contradictory or supplementary general terms and conditions, their validity and application shall hereby be excluded; these shall only become an integral part of a contractual agreement when we have expressly agreed to them.

2. Contractual partners, contract conclusion
The purchase contract shall be established with Tourist Information EdelSteinLand.

By placing the products in the online shop, we are submitting a binding offer regarding the conclusion of a contract for these articles. You may initially place our products in the checkout basket without obligation, and you may correct any entries you have made at any time before submitting your binding order; this can be done by using the corrective assistance, which is provided and explained during the course of placing your order. The contract shall be deemed valid when you accept the merchandise placed in the checkout basket by clicking on the order button. You will once again receive a confirmation email immediately after submitting your order.

3. Contract language, contract text record
The languages in which the contract may be concluded are German and English.

We shall store the contract text and send you the order information and our General Terms and Conditions via email. The T&Cs may be viewed and downloaded from this website by you at any time. You may view your previous orders in our Customer Login area.

4. Terms of delivery
Shipping costs will be charged in addition to the stated product prices. For more information on shipping costs and their amounts, please consult our offers.

In principle, you have the option to collect your purchase from the following address: Tourist Information EdelSteinLand, Hauptstraße 419, 55743 Idar-Oberstein, Germany, between the following hours of business: 15.3 - 31.10. Monday to Friday 9 AM - 6 PM, Saturday, Sunday, Public Holidays 10 AM - 3 PM; 1.11. - 14.3. Monday - Friday 9 AM - 5 PM.

We do not deliver to parcel delivery depots.

5. Payment
In our shop, you may in principle choose between the following payment methods:

When selecting the ‘Prepayment’ option, we will give you our bank details in a separate email, and will deliver your merchandise after receipt of payment.

During the order process, you will be forwarded to the website of the online payment services provider, PayPal. In order to pay the invoice amount via PayPal, you must have already registered your details there, or register your details for the first time, then log in using your credentials and then confirm the payment instruction to us. After submitting your order via the online shop, we will request PayPal to execute the payment transaction.
The payment transaction is then executed automatically by PayPal immediately thereafter. You will receive further instructions and information during the order process.

6. Retention of title
The merchandise shall remain our property until payment has been made in full.
For businesses, the following additions shall also apply: We shall retain ownership of the merchandise until all receivables stemming from the business relationship have been paid in full. You may resell the merchandise subject to a retention of title as part of your ordinary business activity; any and all receivables resulting from this resale – irrespective of a connection or fusion of said merchandise with a new item – shall be assigned in advance to us in the amount stated on the invoice, and we shall accept this assignment. You shall remain authorised up until the point in time of collection, however, we may also collect any outstanding receivables ourselves, insofar as you neglect to fulfil your own payment obligations.

7. Transport damage
Should any merchandise be delivered with visible signs of damage, we kindly request that you notify the delivery agent of such defects immediately wherever possible, and get in touch with us without delay. Failure to notify the relevant parties of a defect or to establish contact shall not harbour any consequences for your statutory rights and their application, in particular with regard to your warranty rights. We do, however, ask for your help in asserting our own claims vis-a-vis the delivery agent and transport insurance company respectively in such a case.

8. Warranty and guarantees
Statutory warranty rights shall apply. Information on any applicable additional guarantees and their exact conditions can each be found along with the product and on the online shop’s dedicated information pages.

We are neither obligated nor willing to participate in a dispute resolution process involving a consumer arbitration board.

10. Final provisions
If you are classified as a business, then German law shall apply in conjunction with UN sales law.

If you are a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction shall be our company headquarters for all disputes between you and us arising from contractual relationships.
